Hi neighbor, the site is still in development as it was pretty much just born in a weekend; more features and info will be arriving soon. Alright lets continue the program, we are here to prevent an entity, which is an HOA in this case, have power over our neighborhood. Some of us may have been sent a notice from the HOA at this point, having the potential of creating fear and intimidation. We are all adults here and do not need another entity to babysit us or play hall moniter and have the power to fine, to notice, to lien, to forclose, etc. as previously stated in the flyers. We also have federal, state, county, and city laws plus one of the covenants however they are using Phase A, B, C, and D covenants to apply to every home. Read the part in the covenants on the first page that says, "being more particulary described as Lots..."; check the maps page to see where your lot is and which covenant affects you. There has been hearsay about one attorney saying the covenants are dissolved and another saying they have been renewed, searching for more documentation in the meantime. If the universal convenant is in place, we may even lose more rights on what we can do with our own property, and even though they are looking for a way to make a $125 mandatory yearly fee which seems fine at first since its only "$125"; they will be allowed to increase it and you lost one more right as a property owner. Every new, mandatory rule means one less right for you. We plan to make this site that would function similar like an HOA without anyone in this neighborhood having more power than another, removing the potential of becoming a dictatorship, and more cost efficient as it won't have corporation fees that do not go towards the neighborhood and paying for an expensive venue for annual meetings. Time is saved as well with no political talk and straight to the point with the website containing all information and if it doesn't, we can add it! Everyone has the right to know every detail (public records only) of our property that is part of the mission for your own inquiries and knowledge and to keep check & balances. Let us keep this place as a neighborhood where we can relax and enjoy our property not a corporation with corporate politics added in the mix.

(d) (1) Notwithstanding the limitation provided in subsection (b) of this Code section, covenants restricting lands to certain uses affecting planned subdivisions containing no fewer than 15 individual plots shall automatically be renewed beyond the period provided for in subsection (b) of this Code section unless terminated as provided in this subsection. Each such renewal shall be for an additional 20 year period, and there shall be no limit on the number of times such covenants shall be renewed. (2) To terminate a covenant as provided in paragraph (1) of this subsection, at least 51 percent of the persons owning plots affected by such covenant shall execute a document containing a legal description of the entire area affected by the covenant, a list of the names of all record owners of plots affected by the covenant, and a description of the covenant to be terminated, which may be incorporated by reference to another recorded document. By signing such document, each such person shall verify that he or she is a record owner of property affected by the covenant. Such document shall be recorded in the office of the clerk of the superior court of the county where the land is located no sooner than but within two years prior to the expiration of the initial 20 year period or any subsequent 20 year period. The clerk of the superior court shall index the document under the name of each record owner appearing in the document.
Pointing out the renewal of the covenants, and we have missed the time period where we the people can terminate them.
"Membership in this organization shall be open to all who are homeowners or property owners and who are current with all dues and assessments charged by the Corporation."
That sounds voluntary to become a member of the HOA. It did not say like, "Membership applies to homeowners or property owners in this subdivision."
Now if one conducts themselves to be a member of the organization such as paying dues or signing one of their documents, the by-laws may apply to you like an employee following company policies. Grab a copy of the original by-laws in the Other Resources section in Google Drive.
How will we pay the lights, landscaping, etc. without an HOA?
We will create a donation page for people to donate to whatever project or bill they value the most for the neighborhood. We want it to be explicit that its voluntary as you have a choice in the matter. Receipts and other financial documentation will be posted. Posting as much evidence as possible that you can download if you like. Future Website Designs in Other Resources section gives an idea what it would be like.
What happens if there are issues like the AirBnB incident?
Try to solve it on the city level first before we create our own solution to the problem. Use what is already in place before creating more complexity. We can have an issues page where we can help each other to resolve the issue.
How can we do neighborhood yard sales?
If we want to do neighborhood yard sales, we can buy one re-usable banner for the front entrance to advertise the site's public events page that will have a calendar feature of when we will do any events. Removes the cost of buying banners for each advertised date, and guests can re-check the date and time with weather predictions.
How wil the comment system work?
The future, potential plan is each household will have 1 user account. We will have all accounts created beforehand and can give out the initial username and password when requested for you to update later. The only proof that is needed is a government issued ID to ensure you live here like a driver license. We do NOT want to keep any private information in the database or a physical document or copy of the ID. We only keep the address since that is needed so not to give 2 or more accounts away to the same address.
What are other future plans for the site?
Updating the site with the latest open records information when received, news, etc. A comment system to talk about the documents that affect our neighborhood with ways to disect the documentation. There will probably be a page with suggested ideas and people can do a thumbs up on whichever is higher priority. The mission is to get a functional version 1 of the site by around the middle of May this year to do most of the work that an HOA does to benefit the neighborhood. We need to ensure testing of the site is working properly, definitely the donations page. The donations page with receipts, creation of user accounts, a comments system, and posting documentation/findings are the most important features.
